Conditions of entry

1. Information on how to enter and prizes forms part of these Conditions of Entry. Entry into the ‘Winter Warmer Home Essentials Display Home Prize Draw’ (Promotion) is deemed to be an acceptance of these Conditions of Entry.
2. Promotion commences Friday 1st July 2022 at 12.00 pm and entries close at 5.00pm AWST on Sunday 31^st July 2022 (Promotion Period) – entries will be accepted during Display Home opening times. Visit celebrationhomes.com.au, dalealcock.com.au or wa.homebuyers.com.au for opening times.
3. Entry is open to Australian residents domiciled in Western Australia over the age of 18 years. Directors, officers, management employees, suppliers and contractors (and their immediate families) of the Promoters are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, stepsister or 1st cousin.

To enter, entrants must:

4. Visit any Celebration Homes, Dale Alcock Homes or Homebuyers Centre Display Home in Perth Metropolitan or South West WA, register their details via QR scan located in each Display Home.
5. Entries are limited to one registration per Display Home visited.
6. Entries are deemed to be received at the time of receipt by the Promoter. Records of the Promoter are final and conclusive as to time of receipt.
7. All valid entries received during the Promotion Period will be placed in a draw to be held at 301 Vincent St, Leederville, WA, no more than seven days after the Promotion Period concludes. The first valid entry drawn will win a Dyson V7 Motorhead Origin Cordless Vacuum valued at $399. The second valid entry drawn will win a Smeg 50s Retro Style Kettle (White) & Smeg 50s Retro Style 4 Slice Toaster (White) valued at $418. The third valid entry drawn will win a Ninja Blender Duo with Auto-iQ valued at $268. The fourth valid entry drawn will win a DeLonghi Citiz & Milk Nespresso Capsule Coffee Machine in Black valued at $318. The fifth and sixth valid entry drawn will win an Adairs voucher worth $150 each.
8. The winners will be notified no longer than 7 days after the end date of the Promotion Period. If the winner does not claim the prize after 7 days of being drawn, the Promoter reserves the right to redraw the prize and announce another winner.
9. The prize cannot be exchanged for cash. The prize must be taken as offered and cannot be varied. The Promoter’s decision is final, and no correspondence will be entered into, including in the event of a dispute.
10. The Promoter reserves the right to validate and check the authenticity of entries, and to disqualify any entrant for tampering with the entry process, or who submits an entry that is not in accordance with these Conditions of Entry.
11. Subject to the unclaimed prize draw clause, if for any reason the winner does not:
    1. take or claim a prize by the time stipulated by the Promoter; or
    2. meet the Purchase Condition,
    3. then the prize will be deemed to have been abandoned or waived by the winner and any voucher issued prior to the Relevant Date will be cancelled.

12. The Promoter and its associated agencies or companies accept no responsibility for lost, late, stolen, damaged or misdirected entries.
13. If for any reason this Promotion is not capable of running as planned, the Promoter reserves the right in its discretion to modify the terms of the Promotion including the prizes and these Conditions of Entry, subject to approval of the gaming authorities in each State and Territory where relevant.
14. The Promoter is not responsible for any tax implications arising from winning or using the prize. Any winner should seek independent financial advice.  If for GST purposes this Promotion results in any supply being made for non-monetary consideration, entrants must follow the Australian Taxation Office’s stated view that where the parties are at arm’s length, goods and services exchanged are of equal GST inclusive market values.
15. The Promoter will not be liable for any injury, loss or damage of any nature whatsoever (including but not limited to indirect or consequential loss) which is suffered or sustained as a result of or in connection with receiving, taking or using any prize except for any liability which cannot be excluded by law.
16. If any act or omission, event or circumstance occurs which is beyond the reasonable control of the Promoter and which prevents the Promoter from complying with these conditions of entry, the Promoter will not be liable for any failure to perform or delay in performing its obligation and the Promoter reserves the right (subject to any applicable law) to cancel, terminate, modify or suspend the Promotion.
17. By entering the promotion you give Dale Alcock Homes, Celebration Homes, Homebuyers Centre and Dale Alcock Homes South West consent to use your personal information for further purposes and promotions.
18. All claims and entries become the property of the Promoter. The Promoter requires your personal information in order to conduct the Promotion. If you do not provide the mandatory personal information requested, then you will not be able to take part in the Promotion.  By entering this Promotion, each entrant is taken to consent to the Promoter using the entrant’s personal information to administer the Promotion, announce the winner (which will be published on the Promoter’s website for 28 days from the draw date) and disclose the entrant’s personal information to organisations that assist the Promoter with administering the Promotion and announcing the winner, and to third parties as required by law (including authorities that regulate this Promotion).  The Promoter is bound by the National Privacy Principles in the Privacy Act 1988 (Cth) and by entering the Promotion, the entrant is taken to consent to the Promoter’s privacy policy (which is available on request).  By entering into this Promotion, each entrant also consents to the Promoter using their personal information for future marketing purposes, unless otherwise advised by the entrant.   Visit dalealcock.com.au/privacy-policy/ , www.celebrationhomes.com.au/privacy-policy or www.wa.homebuyers.com.au/privacy-policy for the Promoter’s privacy policy, which contains information about how entrants may seek to access or correct their personal information held by the Promoter or complain about a breach of their privacy, and how the Promoter will deal with that complaint.
19. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this Promotion (including any outcome).
20. Nothing in these Conditions of Entry limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act 2010 (Cth), as well as any other implied warranties under similar consumer protection laws in the States and Territories of Australia (Non-Excludable Guarantees).
21. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents):
    1. excludes all liability (including negligence), for any personal injury, or any loss or damage (including loss of opportunity) whether direct, indirect, special or consequential, arising in any way out of the promotion; and
    2. without limiting clause 29(a), is not responsible for and excludes all liability in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Conditions of Entry; (e) any tax liability incurred by a winner or entrant; or (f) use of a prize.
22. This Promotion is in no way sponsored, endorsed or administered by, or associated with any social media platform, including Facebook, Instagram and Twitter. Entrants provide their information to the Promoter and not to any social media platform.  Entrants completely release any relevant social media platforms from any and all liability.
